SEISMETEO – END USER LICENSE AGREEMENT (EULA)

This license agreement ("License") governs your use of the SeisMeteo application for iPhone and iPad, including the optional SeisMeteo Pro features (together, the "App"). By downloading, installing or using the App you accept this License. If you do not accept it, do not use the App.

1. Who provides the App

The App is provided by Cristian Palandrani (the "Developer"), an individual. You can send any questions, complaints or claims about the App to:

2. An agreement between you and the Developer, not with Apple

You and the Developer acknowledge that this License is concluded between you and the Developer only, and not with Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for the App and its content. This License does not provide for usage rules that conflict with the Apple Media Services Terms and Conditions in effect on the date you accept it.

3. License to use the App

The Developer grants you a personal, non-exclusive, non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions. The App may also be accessed, acquired and used by other accounts associated with the purchaser via Family Sharing, volume purchasing or Legacy Contacts.

You may not sell, rent, sublicense or distribute the App, nor decompile, disassemble or modify it, except where applicable law expressly allows this and cannot be waived.

4. What the App is, and what it is not

SeisMeteo is an information app. It shows weather forecasts, weather alerts issued by third-party bodies, earthquakes located by seismological institutes and seismograms from public seismic stations.

SeisMeteo is not a warning system and does not replace the instructions of civil protection or other competent authorities. Do not rely on the App for decisions on which the safety of people or property depends: if there is danger, always follow the official instructions of the authorities.

In particular:

• the data come from third-party sources and may be incomplete, inaccurate, revised over time or delayed; earthquake estimates (magnitude, location, depth) often change in the hours after the event;
• earthquake notifications come from a periodic check that iOS runs when it sees fit: they may arrive hours late or not at all;
• the alerts shown depend on the availability of Apple's services and of the bulletins of the Italian Civil Protection Department: if the App shows no alerts, it does not mean there are none;
• seismograms are processed plots (decimated and centered on zero) of station data: they show when shaking arrives and how much it stands out from background noise, not its magnitude.

5. Apple weather data

Weather alerts are provided through the Apple WeatherKit service. As required by Apple's terms, the following notice applies:

YOUR USE OF THIS REAL TIME WEATHER GUIDANCE APPLICATION OR WEBSITE IS AT YOUR SOLE RISK. WEATHER DATA MAY NOT BE ACCURATE.

6. Data sources and third-party terms

The App uses data from: MET Norway (weather forecasts); Apple WeatherKit (weather alerts); Apple MapKit (maps and city search); the Italian Civil Protection Department, via allertameteo.app (hydrogeological and hydraulic weather alerts in Italy); USGS, EMSC-CSEM and INGV (earthquakes); EarthScope, GEOFON (GFZ), Epos-France, INGV, SED-ETH Zurich, BGR, NCEDC, SCEDC, BGS, NOA, GeoNet, USGS and AVO (seismograms). Each source retains its rights in its own data, which the App displays under the respective licenses. The full list, with licenses and attributions, is in the App (Settings > Sources and Licenses) and at https://seismeteo.com/en/sources/.

The Developer does not control these sources and does not guarantee that they will remain available: a source may stop or change its service at any time, and the Developer may have to remove data or stations from the App.

When using the App you must comply with any applicable third-party terms, including the Apple Media Services Terms and Conditions and your agreement with your mobile data provider.

7. SeisMeteo Pro (in-app purchase)

• The App is free. SeisMeteo Pro is an optional in-app purchase, paid once with no subscription, that unlocks additional seismogram tools. The features included are described in the App before purchase. Weather, alerts, earthquakes, notifications and widgets remain free.
• The price is the one shown by the App Store at the time of purchase. Payment, billing, refunds and any right of withdrawal are handled by Apple under the Apple Media Services Terms and Conditions. The Developer does not receive your payment details.
• SeisMeteo Pro can be shared with Family Sharing. You can restore it on other devices signed in with the same Apple Account by tapping "Restore Purchases" in Settings > SeisMeteo Pro.
• People who bought the earlier paid version of the App ("SeisMeteo Pro") get the Pro features at no cost once the App Store confirms the original purchase on the device.
• Pro features display third-party data (see section 6): the availability of any particular station or time window is not guaranteed.

8. Maintenance and support

The Developer is solely responsible for providing maintenance and support for the App, as described in this License or as required by applicable law. You can ask for support at support@seismeteo.com. You and the Developer acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

9. Warranty

The Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. Nothing in this License affects your statutory rights as a consumer, including the legal guarantee of conformity for digital content and services.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be the Developer's sole responsibility.

Subject to the mandatory rights mentioned above, the App and the data are provided "as is" and "as available", without any warranty of accuracy, completeness, timeliness or continuous availability.

10. Limitation of liability

To the maximum extent permitted by law, the Developer is not liable for indirect or consequential damage arising from the use of, or inability to use, the App, or from decisions taken on the basis of the information it shows, including delays, errors or missing data, alerts or notifications. This License does not exclude or limit the Developer's liability for willful misconduct or gross negligence, for personal injury, or in any other case where the law does not allow it, and does not limit the Developer's liability beyond what applicable law permits.

11. Product claims

You and the Developer acknowledge that the Developer, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.

12. Intellectual property

The App, its code, name, logo and design belong to the Developer, except for the third-party components listed in the App (for example libmseed, under the Apache License 2.0, and yyjson, under the MIT License), which remain subject to their own licenses. You and the Developer acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such claim.

13. Legal compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

14. Apple as third-party beneficiary

You and the Developer acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this License, and that, upon your acceptance of this License, Apple will have the right (and will be deemed to have accepted the right) to enforce it against you as a third-party beneficiary.

15. Privacy

The App has no servers of its own, requires no account and contains no tracking or advertising. How data is handled is explained in the privacy policy: https://seismeteo.com/en/privacy/.

16. Term, changes and termination

This License applies for as long as you use the App and ends automatically if you breach it; in that case you must stop using the App and delete it. The Developer may update the App, change its features or stop distributing it. The Developer may also change this License: the updated version will be published at https://seismeteo.com/en/terms/ with its date and, for significant changes, announced in the App. Changes do not affect your statutory rights as a consumer.

17. Governing law and jurisdiction

This License is governed by Italian law. If you are a consumer, you keep the protection of the mandatory provisions of the law of your country of residence, and disputes may be brought before the courts of the place where you live.
